Painesville Judge: Man sentenced to view traffic fatality

PAINESVILLE -- Painesville Judge Michael Cicconetti's latest "creative justice" sentence has a man found guilty of driving while drunk viewing fatalities at either the county coroner's office or the emergency room of a hospital.

Cicconetti found Jonathan Tarase, 18, of Kirtland, guilty of operating a vehicle while intoxicated after a traffic stop by the Highway Patrol at 11:45 p.m. Oct. 15.

Tarase had pleaded not guilty Oct. 16 and was assigned a public defender. He had also been charged with running a stop sign but that charge was dismissed.

Cicconetti sentenced Tarase to 65 days in the Lake County Jail; parole for six months; $852 in fines and court costs; and suspended his driver's license for six months except for driving to work or to medical appointments.

He must report to jail at 7 p.m. April 19 to serve the five days.

Tarase also must be on call for two days -- in addition to his jail time -- to view a traffic fatality at either the Lake County Coroner's Office or a local hospital's emergency room. The arrangements will be made through the probation department for viewing.

Cicconetti has been handing out his self-described "creative justice" since he took the bench in January 1994 and is currently serving his third, six-year term.

Other examples of his "creative justice" include:

  • During heavy blizzards, he ordered defendants to clear snow at a retirement home
  • A man caught with a loaded gun was sent to a morgue to see corpses
  • A woman who abandoned 35 kittens in a forest was told to spend a night in the woods
  • A man who shot a dog was sentenced to donating 40 pounds of dog food on every holiday to the Lake County Animal Shelter
  • Two teenagers who scrawled "666" on a nativity figure of Jesus had to lead a donkey through the streets, with a sign saying: "Sorry for the jackass offense."
  • Teenagers who flattened tires on school buses were ordered to throw a picnic for primary school children
  • A man who shouted "pigs" at police officers was made to stand on a street corner with a pig and a sign that said "This is not a police officer."
